TERMS:  For live bidding, $25,000.00 cash/cashier’s check deposit made out to Cunningham & Associates Real Estate, LLC in order to obtain a Bidder’s card.  This deposit is refundable to all unsuccessful bidders.

                     For on-line bidding, upon registration, you may either mail or hand deliver a $1,000.00 cash/cashier’s check deposit made out to Cunningham & Associates Real Estate, LLC in order to obtain a Bidder number.  We can also send you instructions for a wire transfer of $1,000.00 deposit. After we receive your deposit, you will be issued a bidder number.

Please Note:  Friday 8/31/07 we will require an additional $24,000 from the online bidders. This deposit is refundable to all unsuccessful bidders. 

Balance of successful bid must be paid in cash or cashier’s check no later than 9/10/07, 12 PM to Fidelity National Title Co.  All Bidders are encouraged to personally inspect the subject property prior to auction as this property will be sold “as is” and “where is”.  Close of escrow to occur on or before 9/14/07.  Fidelity National Title Co. shall be escrow company.  All closing documents must be signed and returned to the title company no later than 9/10/07.  Buyer to pay all escrow fees/title fees/recording fees.    Bidders must conduct all due diligence to satisfy themselves prior to bidding, including on-site inspections, land investigations, and title searches.  Bidder understands Bidder is purchasing subject property in “as is” condition and as such waives his/her review and approval of seller disclosure statement.  Seller guarantees subject property will convey to Buyer free and clear of all liens and encumbrances.  Above information is deemed reliable, however it is the responsibility of each Bidder to confirm above information prior to auction. 

The successful Bidder agrees to the above terms and conditions, waives all inspections/surveys after auctioneer says “sold”, and agrees to agency disclosure that Cunningham & Associates Real Estate, LLC represents the seller exclusively.
